California Updates Laws to Combat Distracted Driving, Street Racing – What Can You Do if You are Injured by a Driver that Was Not Following the Law in Ventura?

_DistDriv

There is no doubt that by now most drivers and their families in Ventura are aware that distracted driving – particularly, using a cell phone while driving – is a dangerous activity that can lead to serious and fatal car accidents. However, the truth of the matter is that drivers throughout Ventura still drive while distracted, including using their cell phones while driving. To help combat this distracted driving phenomenon, the State of California has passed new laws aimed at helping keep Ventura drivers safe.

According to local news reports, the State of California made significant updates to its traffic laws regarding distracted driving. The new laws came on the heels of a ruling by a California Appeals Court that it is unlawful for California drivers to hold a phone while they are driving. However, under the ruling, which went into effect in June, California drivers are still permitted to mount a cell phone onto their dashboard or windshield when using GPS navigation and may still use voice commands or Bluetooth technology to operate their phones with a “single tap or slide when it’s mounted.”

In addition to the new distracted driving laws that became effective in June, on July 1, California laws were amended so that “courts in the state may order a person’s driver’s license to be suspended for 90 days to six months ‘for exhibition of speed, or aiding and abetting an exhibition of speed, if the violation occurred as part of a sideshow.’” Lawmakers, community members, and individuals alike are hopeful that these news laws will make for safer and less distracted drivers in California.

Your Rights and Options if You Are Injured Due to Another Driver’s Unlawful, Distracted Driving

Ventura drivers that are injured due to another driver’s distracted, or otherwise negligent conduct, have rights and options to justice under California personal injury laws. Under California personal injury laws, victims of serious car accidents may be entitled to file a lawsuit in court for money compensation. These are called personal injury actions. There is a limited time to file a personal injury lawsuit in Ventura, so it is best to speak with an experienced Ventura car accident lawyer about your case as soon as possible after a serious car accident occurs.
